Personal Goal Paper

Personal goals are achieved through dedication and the love of what you are doing. Nobody can decide one person's personal goals for themselves because it is only made by them and it reflects their character and interests. A personal goal that I have is to serve people in need whether that is through mission trips, volunteer work, or a child sponsorship. The steps that I will need to take in order to reach my goal of serving others is to get involved in a church that is committed to serving others, volunteer locally and be a part of credible programs, and seek children in need to pompons on a regular basis.Missions work is something that I have always wanted to do but never have had the opportunity of doing. The church that I went to back at my home church would always go to Guatemala every year to rebuild communities and teach the gospel of Jesus Christ. I have never went, but it was always a goal of mine to go. In order for me to reach my personal goal of going on mission trips, I need to get involved in a church that consistently goes on mission trips. Being a part of a dedicated group of Christians in order to spread the word of Jesus and restore the hearts and minds of any, would be very rewarding to me.I have done volunteer work In the past but a goal of mine Is to do It more out of love and compassion for others and their environment. In order to make this goal happen, I need to find volunteer programs or places that would allow me to show the love of God to others and serve them both physically and spiritually. In the past I was a part of the Market Street Mission coat drive In which I helped people find coats for themselves and their families In order for them to keep warm during the winter. It was a wonderful experience that gave me Joy and kindheartedness towards the needy.In order to achieve my personal goal of serving others, I would Like to sponsor a child In need In another country. It would be an awesome feeling to see how much my money and love towards a child Is making a huge difference In their life and how they live It. Writing to the child and receiving letters from him or her would allow me to connect with the child more affectionately. It would also allow me to give him or her hope for a better future and write Inspiring Bible verses. Personal goals are not Just goals you check off on a list. Rather, they allow you to discover a deeper truth about yourself and society as a whole. Moreover, Thomas Aquinas explains how unfair and unjust merchants are for they price their goods higher than what the product actually cost. International Construction Contracts and Dispute Resolution Discuss the distinction between the role of the Engineer as an agent of the Employer and the Engineer as independent of the Employer. Discuss also whether the distinction is useful, and whether and where (and why) it might be abandoned or retained. In addition, consider and list the provisions in the FIDIC Conditions (Red Book) (1999 ed.) whereby the Engineer performs functions as: Agent of the Employer; and/or Independently of the Employer   The employer in a project is not an expert in the field of construction. The employer is one who only knows business thus, he needs someone with expert knowledge in the field to help him implement his project successfully. It is at this juncture the engineer comes into the scene who has the expert knowledge and helps the employer implement his project. He is employed by the employer and works for the employer in many different roles. As Dr Donald Charrett list out a series of thirteen roles that the engineer has to play, we can see that the engineers role comes into play much before the construction starts. Here it is the role that he plays after the contractor is appointed and the construction starts, we will see the multiplicity and conflict in his role as an engineer. The role that will be at focus in the essay, in broad terms is his role as an agent of the employer and as a decision maker. The essay will try to differentiate and discuss the roles in which the Engineer acts as an agent of the employer and roles where he acts independently from the employer. We will do this by looking out first as to how the concept of todays Engineer as an agent of the employer had developed and then discuss the different FIDIC condition that define and differentiate the role of the engineer. In the next part the discussion will focus on the independence of the engineer and will define the roles where the employer acts as an agent of the employer and where he is independent of the employer. I will deal with the provision of FICID not as a separate part, rather will list and discuss it with the first part of the question. At this stage I find it pertinent to first discuss who the engineer is according to FIDIC. The definition of an engineer can be found in sub clause 1.1.2.4 of red and yellow book: Engineer means the person appointed by the Employer to act as the Engineer for the purposes of the Contract and named in the Appendix to Tender, or other person appointed from time to time by the Employer and notified to the Contractor under Sub-Clause 3.4. This doesnt explain what the engineer job or role is as it has been dealt with by FICID under different sub-clauses under clause three. In a nut shell the Engineer is a individual whose role can be said to the project manager where he has to implement different aspect of the contract. In sub-clause 1.1.2.6 of red and yellow book the engineer is stated to be an employers personal. Sub-clause 1.1.2.6 stated: Employers personnel means the engineers, the assistant referred to in sub-clause 3.2 and all other staffs, labour and other employees of the engineer and of the employer; and any other personnel notified to the contractor, by the employer or the engineer, as the employers personnel. Looking at both the definition clause it becomes clear that the engineer is one who is appointed by the employer and is considered as employer personnel. One thing that come out clear from the definition clause is that the Engineer is always an employee of the Employer. The gives rise to the question, if the engineer can be independent at any circumstance though the contract or at the least be fair and impartial. The Engineer has multiple role to play which are related to the contract and some of his role as the Engineer starts much before the contractor is appointed. The Engineer was brought into the picture by the employer much before the contractor is appointed. The Engineer is brought in at the initiation stage as he is required to multiple works like assessing the design, advising on the contractor to the employer and sometime vet the projects viability to third party financer. With so many roles relating to the employer, can the engineer be expected to be independent. Historically it depended on the term of a contract to decide if the engineer was independent of the employer or not. In Ranger v Great Western Railway Co[1]the court by interpreting the contract found that the engineer was never independent and his decision were therefore the decision of the company. Whereas in in In re De Morgan, Snell Co. and Rio De Janeiro Flour Milling Co.[2], the chief engineer and the resident engineer were found to be independent from the employer. The basis was that where the engineer had autocratic control over the work and had the power to issue final and binding decision, was considered to be independent from both the contracting parties.[3] The courts saw this authority as a conflict of interest hence, applied very strict standard to the way engineers executed his authority and power.[4] This resulted in a change in The way the Engineer was related to the employer. The way the Engineer was related to the employer moved to a more modern form of the relationship we see today, where the Engineer mostly stands as an agent of the employer. The authority, duty and obligation ware still derived from a contract and this resulted in courts taking a stricter stance on the role of an engineer.   The courts have always imposed stricter and higher standard on the functioning of The Engineer. In cases where the contract engineer was the agent of the employer, the parties to the contract enter into the contract stating that the engineer has to undertake number of duties for the implementation of the project. Courts have mostly held that the engineer in case of absence of any words to the contrary in the contract is expected to act fairly in case of his role as a decision maker. Mc Farlan J in the case of Perini corporation v Commonwealth of Australia[5] had stated that, during the performance of all the duties under the contract the engineer will remain an employee of the government(Employer). Even during the discharge of his duty as a decision maker he continues to be the employee of the government, but he is still expected to act fairly and justly with skills towards both parties to the contract. In the modern form, we see that the engineer became an agent of the employer in his different roles under the contract, but he was still expected to act as an independent person should work, who must be fair, impartial and honest towards both the parties when acting in his role as a decision-maker under the traditional system. But the industry moved on from the independent form of the Engineer and the system of impartial Engineer as a decision-maker was adopted. The concept of an impartial engineer was incorporated in the modern form of contractual provision for construction contracts (FIDIC). 3.1 Fidic On The Role Of An Engineer The engineer under the old FIDIC red book was expected to act impartially. As was stated under sub-clause 2.6: (d) otherwise taking action which may affect the rights and obligations of the Employer or the Contractor, he shall exercise such discretion impartially within the. The incorporation and requirement of the impartiality of the Engineer was because of the realisation of the fact that there will always be a doubt on the impartiality. The presence of the doubt is because of the presence of conflict of interest as the Engineer is now the agent of the employer. Then over a period of time it was realised that the expectation of impartiality cannot be also confirmed. So there was again a change occurred from the requirement of being impartial to being fair. According to Ola Ø. Nisja the concept of fairness developed through case law in the common-law system as the engineer was expected to be a person with professional ethics and you can expect from him to be a fair decision maker. Ola Ø. Nisja   also states that the concept of a fair decision maker was not in common practice till the FIDIC form included it in their standard form of contract. Hence in the 1999 edition of FIDIC red book and yellow book the concept has been replaced with the concept of fairness with word fairly under clause 3.5 and the concept of impartiality wasdone away with. The reason being there will always be doubt on the impartiality of the engineer and that can be easily removed from the contract by words that can negate the expectation of impartiality. The thought has been made apparent by Lord Hoffmann in Balfour Beatty Civil Engineering Ltd v Docklands Light Railway[6] where he has stated that, the architect is the agent of the employer, so he is a professional man but can hardly be considered to be independent. He speaks of the architect who is appointed in the role of The Engineer, where you can still expect an individual to be fair if not independent or impartial. Intellectually speaking the concept of being fair is inherent to the nature of a decision maker that is expected in a common law system and it is easier to expect the engineer to be fair than being impartial. Even when the contract doesnt impose any obligation in any way, the engineer is still expected to act in a, honest, fair and reasonable manner when under taking the role of a decision-maker. The above observation comes from Balfour Beatty Civil Engineering Ltd v Docklands Light Railway Ltd only where there was no appointed engineer for the project and the employer itself through its own employee took up the duty of decision maker, he was still expected to be fair, honest and reasonable[7].   Other than the implied duty of acting impartially there is ex pressed duty under the code of ethic to act impartially also. Of the many issues that challenge the impartiality of the engineer one that, the engineer has to make a decision regarding to his own work. In such position there cannot be an expectation for impartiality at all. Of the many roles that Dr Donald Charrett list most of them have been infused into new role of an engineer in the modern time where he is the agent of an employer. As an agent, the duty of the engineer is to successfully implement the project which is surrounded around the condition that he has to work in the best interest of his employer. But as a decision maker he takes relief from his role as an agent of the employer and is expected to act as a neutral decision maker between the employer and contract and fairly decide the dispute. The clear differentiation of the engineers role can also be seen in standard form of contracts and specifically FIDIC. The role of an engineer is dealt in different sub-clause of clause three of both the FIDIC red and yellow book. Condition 3.1 deals with the duty and authority of an engineer and condition 3.1 (a) of both the red and yellow book state: Expect as otherwise stated in these condition:       Whenever carrying out duties or exercising authority, specified in or implied by the contract, the engineer shall be deemed to act for the employer; This makes it pretty clear that the employer is expected to act an agent of the employer in relation to any of the act he is required to do under the contract. And condition 3.5 of red and yellow book state deal with the role of an engineer as a decision maker, where it states that: If agreement is not achieved, the Engineer shall make a fair determination in accordance with the Contract, taking due regard of all relevant circumstances. It is clear from the wording of the FIDIC form of standard contract the engineer is in a position to represent the Employer in all matter, however he also has the obligation to discharge his contract obligation as a decision maker in a fair manner. Hence, of the many roles, an engineer plays, it is here as a decision maker, the engineer is expected to be fair and evenhanded when he is deciding the dispute. So, what we get in general is a person who is throughout the contract phase an agent but when required he has to act in the capacity of a decision maker and be neutral and fair. The sub-clause provides that he has to act fairly and even if the clause in struck out, under common law contracts there is an implied condition that the engineer still has to act fairly. Although the impartiality has been replaced with the concept of fairness, some author make it clear that the contractor should never assume that the engineer belongs to the employer but rather he should assume that the engineer acts independently and impartially according to his professional standards. The concept of an engineer is not discussed in the civil law system hence, may French courts have been seen struck down any clause which gave power to the engineer to decide a dispute. The problem here is that the role on an engineer and he operates is a common law developed concept which has been best explained by Mc Farlan J in Perini corporation v Commonwealth of Australia[8] . the essence of such a relationship where the engineer acts in dual capacity is that the parties have voluntarily agreed so in the contract. The parties have agreed that they will accept and bind themselves on matter that he is required to decide The engineers duty to act fairly is an obligation that is understood to arise from the term of contract. FIDIC condition is a standard form of contract and when adopted for any project makes it a valid form of contract and clause 3.5 makes its legally binding clause and if the engineers dont act fairly then it becomes a breach of contract. In a contract, it is the duty of the parties to follow the contract and act in good faith towards the fulfilment of the contract. Hence, the duty is somehow on the employer to see to it that the engineer acts fairly to honour the clause of the contract when acting as a decision maker as the Engineer is an employer personal according to the definition. The engineer is a person who may not be himself involved in the dispute but definitely has interest in the dispute. One he is deciding upon a dispute that is there because of a decision he took earlier relating to a work and second, he is deciding something which is going to affect both the parties, and he is related to one of the parties. Then the contract expects the Engineer to not only protect the employers interest, he will also be protecting his interests as his decision is related to one of his work only. While the Engineer takes over the role of the engineer he is still employed by the employer and his salary being paid by the employer so, when the engineer is acting as a decision maker he is getting paid by the employer only for that role too. In view the impeding nature of lack of independence in the role of an Engineer that the FIDIC books have two safe-guards when he is acting as a decision maker: to decide fairly and in accordance to the contract. Then again, to promote fairness the FIDIC book also prohibits the Employer from replacing the engineer with anyone against whom the contract raises any reasonable objection.[9] HHJ Jackson state the legal situation of an engineer in the best possible way in Scheldebouw BV v St James Homes (Grovernor Dock) Ltd [10] The terms of the contract according to which the engineer has to work determine the role and duty of the decision maker There cannot be an expectation that he decision maker is in anyway independent from the employer. But while acting as a decision maker the decision maker is expected to act in an independent, impartial, fair and honest manner. He should act using his professional skill to reach the right decision and should not indulge in any favourism towards his employer. The last point is of interest here where it states that he is expected to act in a manner which is independent from the employer. It gives the notion that the decision maker is never truly independent from his employer, but he is expected to shed that relation while acting as a decision maker. This makes it clear that a decision by the engineer can only be challenged in cases where there is a doubt of impartiality or lack of fairness. Hence, it must be remembered that doubt on the independence of the Engineer can be no more a ground for challenging the decision. However, the Engineer is expected to be fair and neutral, so any possibility or even the doubt of the presence of bias by the Engineer towards the Employers Interest in the decisions and determination of contractual disputes, provides the contractor with the opportunity and the avenue to appeal against the decision of the engineer. After going through the relevant provision of FIDIC, case laws and works of different field expert we can say that in the modern system of construction contract the concept of an independent contractor is not present any more. All the while the engineer is only expected to act independently but there is no actual individuality that is independent of the employer. As I have earlier stated the engineer is always paid a salary by the employer, even when he is acting as a decision maker so there cannot any presumption of independence. The FIDIC condition also moved on to the concept of a fair determination as impartiality can be in question and cant be always expected. The reason being there would always be doubt because the Engineer never stops being the agent of the Employer or as the FICID states Employers Personnel. According to Charles C MacDonald, the Engineer is one individual who lacks the necessary requirement of independence to make important decision, as he is appointed by the employer.[11] Even Redfurn and Hunter in their book agree that the engineer who is appointed by the employer will lack the necessary independence to make important decision.[12] As we take stock all that has been discussed till now all we can say in laymans language, the engineer is never independent but it is his duty to act in an independent manner.[13]   At the end, we can conclude that there is no real distinction between the role of the Engineer where he acts as the agent of the employer and a role which he takes up, that is independent from the employer. No provision in the FIDIC form of contract also differentiate between the role rather the provision make it clear that he remains as agent all the while till the contract is in place. There are safeguards to ensure impartiality and fair decision making but still role like the one of decision maker should not be in anyway related or inclined to any party.   This results in the lack of independence in the decision-making process as the trust in the engineer being fair is also lost. This has in the recent years has only resulted in using the Engineer as a decision maker only a procedural requirement as his decision is just a prerequisite to go for a DAB decision or arbitration. The present form has its advantages as it helps in resolving disputes quickly and is serving its purpose in most of the cases but also has in its own disadvantages. The engineers fairness will always remain a matter of question and doubt. There is no requirement to completely overhaul the present system, there is just a need to reduce the disadvantages. As recommended by Ola Ø. Nisja, one engineer can be appointed as the agent of the employer for all the roles presented by the contract, except the one of decision maker and when a dispute arises, a new engineer who is not part of the project be brought in to decide on the matter The concept of an independent Engineer in practice was lost long ago as we moved to the present form. An Engineer independent of the Employer is a myth.   However, as we saw, even as an agent of the employer the engineer has to act fairly while acting as a decision maker and giving determinations. It will always be a challenge to the role of an engineer but he has to overcome this shortcoming has to show real professionalism. Going to the local grocery store while hungry is always on the list of things not to do. Why? Because while walking up and down the aisles, hunger decides to strike and more grocery items are added to the shopping cart. Another not to do idea for grocery shopping is taking little kids along for the trip. Why not for this one? Because the little kids will want even more in the cart than the hunger attack would. The 19th and 20th century United States of America was the little kids and the hunger attack in the scenario given above. America wanted more. They wanted more land, more power, more international influence, and more control. After being under the hands of Britain for majority of the 18th century, America was ready to explode and make a name for their self, and by their self. With this, no one was going to get in the way until America had made a name for itself. The plan may not have gone as smoothly as the political figures would have liked, but their plan must have worked. Since America is known for having the most resources and being one of the greatest problem solvers in the world , the game plan of making a name worked successfully. Expansion begins within oneself. America was not completely foolish and began trying to exhort their authority in matters where they did not belong when it was still just an eastern coast country. MS affects approximately 3.0 million people globally, with about 300,000 cases in the United States. Twice as many women as men have MS. The average ages for onset of MS is 20-40 years. Scar tissue replaces the myelin, interfering with the transmission of nerve signals and leading to numbness, fatigue, spasticity, loss of muscle control, and various other debilitating symptoms. There are four broad theories concerning the etiology of MS. Although there are no cures for MS, this disease is not fatal. Advancements in technology and medicine enable people with MS to live 90-95% of the normal life span (Si bley, 12). What is Spasticity? There are two types of spasticity prevalent in people with MS: phasic spasms and a sustained increase in muscle tone. Phasic spasms sub-categorize into two types of spasticity: flexor and extensor. In flexor spasticity, the hips and knees of the person bend forward, due to tightening of the hamstrings. When you are driving, you should avoid decreasing the available traction. When you are braking in a straight line, you may use all the available traction for braking. If you are braking and steer or, accelerate and steer, you reduce the available traction. As soon as the traction requirement becomes greater than the amount available, your vehicle will start to skid.   Ã‚  Ã‚  Ã‚  Ã‚  There are several factors, which affect the traction of your vehicle, such as: tires, the road surface, speed, and mechanical condition.  Ã‚  Ã‚  Ã‚  Ã‚     Ã‚  Ã‚  Ã‚  Ã‚  Tires are made with grooved surfaces, which are called treads. They are designed to channel water and such through the grooves to keep the rubber in contact with the road. Different patterns of treads are made for different uses and conditions, such as snow tires, or rain tires. There are two basic types of tires: the bias ply and the radial ply design. The bias ply has the plies (layers of cord impregnated with rubber) criss-crossed. This makes the casing strong in all directions; but the plies have a tendency to rub against each other. This conducts heat and tire â€Å"squirm† and the tires wear more rapidly and provide less traction. The radial ply has plies parallel to each other and perpendicular to the tread. Belts usually made of steel are then attached in the same position as the tread, which then gets applied along with the sidewall. The benefit of this is more flexibility. The tread stays in contact with the road producing more traction. Radial ti res also wear more slowly. You should never mix bias and radial tires on your car.

Geoff Colvin Senior Editor at Large, FORTUNE Talent Is Overrated† by Geoff Colvin is a motivating book that puts outstanding performance into view. It presents a solid case that great performance does not come primarily from innate talent, or even hard work, as is supposed by most people. The realistic value of the book comes from the practical function of the thesis. In talking about world class figure skaters, he said that top skaters work on the jumps they are worst at, whereas average skaters work on those they are already good at. In his words, â€Å"Landing on your butt twenty thousand times is where great performance comes from. † Each of those hard landings is able to teach a lesson. Those who learn the lesson can move on to the next hard lesson. Those who don’t pay the price and learn the lesson never progress beyond it. In other words, hard work and dedication is necessary but not sufficient in itself for developing higher level performance at any endeavor. All great performers get that way by working long and hard, but hard work and long hours obviously don’t make people great. Many people work long and hard and stay mediocre. The meat of the book describes what the author calls deliberate practice, and presents supporting evidence in a convincing manner. It matters what kind of practice, not just how long and how much sweat is spilled. Supportive on definition of innate talent Before considering evidence for and against the talent account, we should be as clear as possible about what is meant by â€Å"talent†. In everyday life people are rarely precise about what they mean by this term: users do not specify what form an innate talent takes or how it might exert its influence. Certain pitfalls have to be avoided in settling on a definition of talent. A very restrictive definition could make it impossible for any conceivable evidence to demonstrate talent. For example, some people believe that talent is based on an inborn ability that makes it certain that its possessor will excel. This criterion is too strong. At the other extreme, it would be possible to make the definition of talent so vague that its existence is trivially ensured; talent might imply no more than that those who reach high levels of achievement differ biologically from others in some undefined way. Yet those who believe that innate talent exists also assume that early signs of it can be used to predict future success. 1) There are many reports of children acquiring impressive skills very early in life, in the apparent absence of opportunities for the kinds of learning experiences that would normally be considered necessary. (2) Certain relatively rare capacities which could have an innate basis (e. g. , â€Å"perfect† pitch perception) appear to emerge spontaneously in a few children and may increase the likelihood of their excelling in music. (3) Biological c orrelates of certain skills and abilities have been reported. 4) Some especially compelling data comes from the case histories of autistic, mentally handicapped people classified as â€Å"idiot’s savants. † Practice makes perfect The best people in any field are those who devote the most hours to what the researchers call â€Å"deliberate practice. † Its activity that's explicitly intended to improve performance that reaches for objectives just beyond one’s level of competence provides feedback on results and involves high levels of repetition. For example: Simply hitting a bucket of balls is not deliberate practice, which is why most golfers don't get better. Hitting an eight-iron 300 times with a goal of leaving the ball within 20 feet of the pin 80 percent of the time, continually observing results and making appropriate adjustments, and doing that for hours every day – that's deliberate practice. Consistency is crucial. As Ericsson notes, â€Å"Elite performers in many diverse domains have been found to practice, on the average, roughly the same amount every day, including weekends. Evidence crosses a remarkable range of fields. In a study of 20-year-old violinists by Ericsson and colleagues, the best group (judged by conservatory teachers) averaged10, 000 hours of deliberate practice over their lives; the next-best averaged 7,500 hours; and the next, 5,000. It's the same story in surgery, insurance sales, and virtually every sport. More deliberate practice equals better performance. Tons of it equals great perf ormance. Tiger Woods is a textbook example of what the research shows. Because his father introduced him to golf at an extremely early age – 18 months – and encouraged him to practice intensively, Woods had racked up at least 15 years of practice by the time he became the youngest-ever winner of the U. S. Amateur Championship, at age 18. Also in line with the findings, he has never stopped trying to improve, devoting many hours a day to conditioning and practice, even remaking his swing twice because that's what it took to get even better. The business side The evidence, scientific as well as anecdotal, seems overwhelmingly in favor of deliberate practice as the source of great performance. Just one problem: How do you practice business? Many elements of business, in fact, are directly practicable. Presenting, negotiating, delivering evaluations, and deciphering financial statements – you can practice them all. , they aren't the essence of great managerial performance. That requires making judgments and decisions with imperfect information in an uncertain environment, interacting with people, seeking information – can you practice those things too? The first is going at any task with a new goal: Instead of merely trying to get it done, you aim to get better at it. Report writing involves finding information, analyzing it and presenting it – each an improbable skill. Chairing a board meeting requires understanding the company's strategy in the deepest way, forming a coherent view of coming market changes and setting a tone for the discussion. Anything that anyone does at work, from the most basic task to the most exalted, is an improbable skill. Why? For most people, work is hard enough without pushing even harder. Those extra steps are so difficult and painful they almost never get done. That's the way it must be. If great performance were easy, it wouldn't be rare. Which leads to possibly the deepest question about greatness? While experts understand an enormous amount about the behavior that produces great performance, they understand very little about where that behavior comes from. The authors of one study conclude, â€Å"We still do not know which factors encourage individuals to engage in deliberate practice. † Or as University of Michigan business school professor Noel Tichy puts it after 30 years of working with managers, â€Å"Some people are much more motivated than others, and that's the existential question I cannot answer – why. The critical reality is that we are not hostage to some naturally granted level of talent. We can make ourselves what we will. Strangely, that idea is not popular. People hate abandoning the notion that they would coast to fame and riches if they found their talent. But that view is tragically constraining, because when they hit life's inevitable bumps in the road, they conclude that they just aren't gifted and give up. Maybe we can't expect most people to achieve greatness. It's just too demanding. But the striking, liberating news is that greatness isn't reserved for a preordained few. It is available to you and to everyone. A Mnemonic System for Digit Span: One Year Later. (2002) | * Chase, William G. , * Ericsson, K. Presented at the Annual Meeting of the Psychonomic Society, (20th), Phoenix, AZ, 8-10 Nov 79. | Talent without deliberate practice is latent† and agrees with Darrell Royal that â€Å"potential† means â€Å"you ain't done it yet. † In other words, there would be no great performances in any field (e. g. business, theatre, dance, symphonic music, athletics, science, mathematics, entertainment, exploration) without those who have, through deliberate practice developed the requisite abilities Colvin duly acknowledges that deliberate practice â€Å"is a large concept, nd to say that it explains everything would be simplistic and reductive. † Colvin goes on to say, â€Å"Critical questions immediately present themselves: What exactly needs to be practiced? Precisely how? Which specific skills or other assets must be acquired? The research has revealed answers that generalize quite well across a wide range of fields. Talent is overrated if it is perceived to be t he most important factor. It isn't. In fact, talent does not exist unless and until it is developed†¦ nd the only way to develop it is (you guessed it) with deliberate practice. Colvin commits sufficient attention to identifying the core components of great performance but focuses most of his narrative to explaining how almost anyone can improve her or his own performance. He reveals himself to be both an empiricist as he shares what he has observed and experienced and a pragmatist who is curious to know what works, what doesn't, and why. I also appreciate Colvin's repudiation of the most common misconceptions about the various dimensions of talent. For example, that â€Å"is innate; you're born with it, and if you're not born with it, you can't acquire it. † Many people still believe that Mozart was born with so much talent that he required very little (if any) development. In fact, according to Alex Ross, â€Å"Mozart became Mozart by working furiously hard† as did all others discussed, including Jack Welch, David Ogilvy, Warren Buffett, Robert Rubin, Jerry Rice, Chris Rock, and Benjamin Franklin. Some were prodigies but most were late-bloomers and each followed a significantly different process of development. About all they shared in common is their commitment to continuous self-improvement through deliberate practice. Colvin provides a wealth of research-driven information that he has rigorously examined and he also draws upon his own extensive and direct experience with all manner of organizations and their C-level executives. Throughout his narrative, with great skill, he sustains a personal rapport with his reader. It is therefore appropriate that, in the final chapter, he invokes direct address and poses a series of questions. What would cause you to do the enormous work necessary to be a top-performing CEO, Wall Street trader, jazz, pianist, courtroom lawyer, or anything else? Would anything? The answer depends on your answers to two basic questions: What do you really want? And what do you really believe? What you want – really want – is fundamental because deliberate practice is a heavy investment. † Corbin has provided all the evidence anyone needs to answer t hose two questions that, in fact, serve as a challenge. It occurs to me that, however different they may be in almost all other respects, athletes such as Cynthia Cooper, Roger Federer, Michael Jordan, Jackie Joyner-Kersee, Lorena Ochoa, Candace Parker, Michael Phelps, Vijay Singh, and Tiger Woods â€Å"make it look so easy† in competition because their preparation is so focused, rigorous, and thorough. Obviously, they do not win every game, match, tournament, etc. Colvin's point (and I agree) is that all great performers â€Å"make it look so easy† because of their commitment to deliberate practice, often for several years before their first victory. In fact, Colvin cites a â€Å"ten-year rule† widely endorsed in chess circles (attributed to Herbert Simon and William Chase) that â€Å"no one seemed to reach the top ranks of chess players without a decade or so of intensive study, and some required much more time. † The same could also be said of â€Å"overnight sensations† who struggled for years to prepare for their â€Å"big break† on Broadway or in Hollywood. | The book adds a few paragraphs or two to the Jack Welch entry in the annals of business history. Neutron Jack† kept people from getting too comfortable, once explaining that it wasn't 100,000 General Electric (GE) employees he eliminated, it was 100,000 GE positions. His radioactive personality aside, Welch had remarkable success grooming top corporate leaders. The equity value of companies run by Welch's proteges – including GE, 3M, Home Depot and Honeywell – may well exceed some national budgets, so it is interesting to learn what qualities Welch encouraged as a mentor. Welch's â€Å"4E's† of leadership help explain how he generated so much value over the years for his grateful shareholders. Krames extracts leadership ideas from Welch's track record and makes them quick and handy. Although the book is more useful than original, we find that the articulation of the 4E's, and the profiles of Welch's proteges make it a solid addition to any business library. Colvin leaves no doubt that by understanding how a few become great, anyone can become better†¦ and that includes his reader. This reader is now convinced that talent is a process that â€Å"grows,† not a pre-determined set of skills. Also, that deliberates practice â€Å"hurts but it works. † Long ago, Henry Ford said, â€Å"Whether you think you can or think you can't, you're right. † It would be â€Å"tragically constraining,† Colvin asserts, for anyone to lack sufficient self-confidence because â€Å"what the evidence shouts most loudly is striking, liberating news: That great performance is not reserved for a preordained few. It is available to you and to everyone. â€Å"

Essay on the Stranger Essay

In the novel the Stranger by Albert Camus, the protagonist Meursault is characterized as emotionless, uncaring, and indifferent, though he is actually an understanding, insightful man who is pleased with a simple, modest life. His lack of emotion towards the superfluous and superficial, along with his lack of judgment for other people’s choices do not make him indifferent; they in fact show how he demonstrates Albert Camus’ philosophy of Absurdism. It is through the characterization of Meursault that the greater theme of Absurdism and the absurdity of life are conveyed. Meursault is often seen as cold and impassive towards others. He is actually characterized in this detached way to personify and embody Camus’ philosophy, and his rejection of the established and predictable. One day when Meursault is spending the day with Marie, she asks him if he would marry her and he says â€Å"it didn’t make any difference† and that they â€Å"could if she wanted to† (41). Most view marriage as an important occasion with many consequences and a lifetime commitment. Meursault’s reaction to Marie’s question is honest and straight forward, and his nonchalance serves to weaken the importance of institutionalized principles. Later, Marie wonders to herself if she loves him, and Meursault says that â€Å"there is no way [he] could know that† (42), as it is not possible for Meursault to know what others feel. This implies that a person’s emotions are determined by the individual, and demonstrates the Absurdist thought that no two people can have the exact same emotions and beliefs, and therefore there can be no shared meaning concerning an emotion. When speaking with his lawyer, Meursault is asked how he felt about his mother’s death, and he says that he â€Å"would rather Maman hadn’t died† (65), which shocks his lawyer. Meursault could be perceived as cold and indifferent for not expressing more emotion towards his mother’s death, but he is simply expressing the absurdist belief that one can have many different emotions and that having a mold or standard for a way a person should feel during a specific situation is absurd. Meursault is simply conveying that emotions he felt for his mother such as love are too intangible to define. Camus portrays Meursault as being very non-judgmental and blase towards other characters actions. This is not because Meursault is emotionless or apathetic, but because it conveys Camus’ belief in personal meaning instead of shared meaning imposed by society. Raymond asks Meursault if â€Å"he’d mind writing him a letter right then†¦ [And he] said no† (32), even though the letter would eventually hurt Raymond’s ex girlfriend. Meursault agrees, not because he is rude or uncaring, but because he is just doing his friend a favor, and because he doesn’t judge others based on a standard set of morals. Before Meursault is scheduled to be executed, the Chaplain attempts for the second time to convince Meursault to embrace Christianity like others before him so that he may be saved. Meursault â€Å"acknowledg[es] that that was their right† (117), but does not agree because he is acting in the Absurdist mindset that judging others based on your own principles is wrong. Meursault goes on to try to convince the Chaplain that a person’s value is not measured by society, for one person could see him as very bad, where as another views him as very good. Meursault’s nature and ability to understand that it is up to the individual to build their own beliefs and values demonstrates the Absurdist belief that every person has the right to assign personal meaning to a part of their life, rather than take from the meaning imposed on their life by society. Camus defines Absurdism as â€Å"the confrontation between man’s desire for significance, meaning and clarity on the one hand – and the silent, cold universe on the other†. Meursault, who is capable of embracing the universe’s silence, especially when facing his own death is what makes him the Absurd hero, and ultimately humanize the Absurd philosophy. Camus uses the character of Meursault to convey the message that it is up to the individual to assign meaning to their life through embracing reality, and to avoid becoming trapped by societal ideals and the â€Å"shared meaning† imposed by humanity. One should not allow fear to limit them.

Legalization of Marijuana Essay

The terms ‘weed’ or ‘grass’ strike meaning to many Americans. When thinking of these terms, they are commonly associated with having the ‘munchies’ also known as being extremely hungry due to the side affects of smoking marijuana. What most Americans don’t realize is the benefits that can come from legalizing marijuana because their minds are clouded by the stereotypes associated with the average ‘pot smoker’. Dismiss the corny jokes and stereotypes for a second and consider the truths that are unveiled. In Timothy Egan’s â€Å"Give Pot a Chance,† Egan looks beyond the stigma of smoking weed and points out the benefits that will come from legalization. Although the government is wrongfully hindering us from legalizing marijuana, it should be a national wide policy due to the large benefit of tax regulations that will and has already arise. Egan starts his opinion with three main arguments: marijuana related drug wars, hypocrisy, and the most important argument he points out is the tax revenue that will be generated. Drug related wars are extremely prevalent today. Egan states that there are over 853,000 arrest made for marijuana related offenses. 60,000 people have been killed because of drug wars and violent crimes regarding the distribution of marijuana. Many people are being affected by the violence of the underground markets. He briefly goes over statistical numbers and significant data to further emphasize his argument for legalization. He quickly delves into the hypocrisy of not legalizing marijuana. He explains how our sports industry would completely collapse without all the legal drugs provided by various companies. Popular products include five-hour energy, red bull, and other pills for other uses. He points out how there were thousands of illnesses and fatalities regarding Five Hour Energy. This is an over the shelf product that can be obtained by anyone. In retaliation, Egan brings up how there are little to no people dying from marijuana ingestion. This also brings attention to one of the most common argument as to why people oppose legalization: that it is  unhealthy for the human body when taken in large doses. Although not explained very well, Egan points out the hypocrisy in the rationale of people thinking this way. Any substance taken in large doses is harmful to any human. Even something as healthy as water is bad in large doses. Although this is not a big part of his argument and does not explicitly say why marijuana is good for one or for the nation, it leads up to and adds to his claim of legalizing marijuana. The main argument for legalization and data that Egan gives is the tax revenue that will come from it. Egan arrives at this data by carefully studying the states that already have legalized medical marijuana including the District of Columbia and 18 other states. Washington State officials estimate that licensed marijuana stores will generate 532 million dollars in revenue every year. On top of that, legalization will decrease all the billions of dollars currently wasted on prosecuting and investigating marijuana cases. Money is being wasted on investigating marijuana cases while in reality most do not even get prosecuted or even fined. Since it is legal in some states and not others, enforcement of marijuana laws are clouded making the United States lose more money. If all states had the same rules it would be easier to regulate and gain an abundance of tax revenue from. Legalization of marijuana will benefit the United States as a nation. Egan agrees that a â€Å"whiff of positive and even monumental change is in the air†. He claims that legalization will benefit us tremendously in many ways, but specifically with the generation of revenue from tax. An influx of money from marijuana taxation would greatly help the United States with financial debt. Egan explicitly links his data to his claim by openly asking his audience to consider his data and apply it to the whole nation and then stating that the taxation would help the United States. He explains that the success from the state of Washington proves that other states will strive as well, thus adding to the success of the nation as a whole. Because there are so many issues and contradicting conflicts surrounding the issue of marijuana, Egan has to state his warrant to further emphasize his reasons for legalization and make apparent the change that could happen. The rhetor, Egan, suggests that the change will most likely happen by stating that â€Å"Obama is uniquely suited to make the argument for change. On his issue, he’ll have support from the libertarian right and the humanitarian left.† Egan implies that since 19 states have  already legalized the use of medical marijuana, many states will follow in their footsteps so it is only a matter of time. Unfortunately Egan had a very powerful qualifier that was not adequately explained. Egan implicitly argues that we, as a nation, should not wait for other states to slowly make the change to legalize. Obama and his administration have the power and more importantly the support to change it now. The lack of explaining this weakened a crucial part of his argument for national legalization. Egan believes national legalization should is needed soon rather than legalization by individual states. At the end of his speech he starts delving into his opinion he quickly adds how the law system is not enforced enough. Egan argues that with legalization nation wide, everyone would be on the same page, which is completely true. With nation wide legalization, the issue of use and abuse can be properly discussed and determined. He uses the example of alcohol and how campaigns against drunk driving have saved countless of lives when alcohol is so easy to obtain. This could be the same way as marijuana. With proper laws, marijuana could be regulated efficiently and safely. Unfortunately he only briefly states this and does not fully explain it clearly. He is implying that marijuana is a problem because congress has chosen to make it a problem because they decided not to deal with it. I thought this did not necessarily weaken his argument but left his audience thinking. Egan was successful at proving his point because of his strong claim, data, and warrant. He chose an engaging and interesting claim that is relatable to many Americans. The sets of data he chose to support his argument was tacitful because all Americans can benefit from money therefore everyone is in some way going to benefit from legalization. Egan makes clear the clouded stereotypes and stigma of marijuana and illuminates the truths involved. No matter our opinion or feelings on the issue, the presentation of information for the audience makes a very convincing argument.
